Victorian Franchisee vs. Department of Health: Jim's Mowing Legal Battle Ends in Tribunal Dismissal

In a recent development, the legal battle between a Victorian franchisee of the home services brand, Jim's Mowing, and the state Department of Health has reached a conclusion. According to official court records, the Victorian Civil and Administrative Tribunal (VCAT) has dismissed the case, marking a significant decision in the franchise and business law landscape.

The tribunal's ruling, issued on 14 December 2023, cited prior determinations in similar cases and previous hearings as a basis for the dismissal. The franchisee had initially sought compensation amounting to $24,000 per week for income lost during the extended lockdowns imposed by the Victorian government, following an initial application for compensation filed with the Victorian Department of Health and Human Services in response to Stage 4 pandemic restrictions in the greater Melbourne area.
